Lindsay Lohan will not be freed from jail this week.

The actress is currently serving a 90-day sentence after she violated the probation from her 2007 conviction for Driving Under the Influence (DUI). She had been ordered to alcohol education classes, but didn’t go to enough.

After her spell inside, Lindsay will have to check into a rehab facility for 90 days under the terms of her new court order.

It has been widely reported the star will not serve her full term at the Century Regional Detention Facility in Lynwood, California, due to overcrowding. When she started her sentence last week it was claimed she would be incarcerated for around two weeks, but it has been rumoured she could be out even earlier.

Los Angeles Sheriff's Department spokesman Steve Whitmore has now denied the claims. “Nothing has changed,” he told E! News.

“When she was incarcerated I said a couple of weeks and it hasn't been a couple of weeks. That turns out to be the first part of next week. It could be Sunday, Monday, Tuesday, something like that.”

Not long before his statement, Lindsay’s lawyer Shawn Chapman Holley had expressed her hope the star would be free by the weekend. Shawn has visited Lindsay in prison several times, and says she is finding it tough. The 24-year-old was not allowed visits from her family over the weekend, which Shawn said she struggled to cope with.

“I have my fingers crossed and Lindsay does too,” Shawn said, referring to plans to get Lindsay out by the weekend.

Shawn added reports Lindsay has been wailing hysterically and been subjected to teasing by her fellow inmates are untrue. She said the star and the other prisoners have a “mutual respect” for each other.

Meanwhile, Lindsay’s father Michael Lohan – who has repeatedly alleged she is addicted to prescription medication, which she denies – has asked the Los Angeles County Sheriff’s Department to investigate a list of doctors he claims “over-prescribed” his daughter drugs.

According to her probation report, Lindsay was taking five prescription medications when she was sentenced to jail - antidepressants Trazadone and Zoloft, Nexium for heartburn, Adderall, which treats her attention-deficit hyperactivity disorder (ADHD) and powerful painkiller Dilaudid. She is understood to have stopped taking some of these before her incarceration began.

Michael has also spoken about his plans to get Lindsay back on track, explaining he has asked Robert Downey Jr. for help. Robert has battled drug addiction in the past and spent time in prison, but managed to turn his life around.

“My people are reaching out to Robert Downey Jr. and to Mark Wahlberg. I know both of them and Mark is a tremendous human being. Hopefully they'll see her before she gets out and she'll get in this rehab and get off these prescription meds, and she'll get her life back,” he said. “She's only on two [medications] right now. Ambien is for sleeping, so I can understand that. But this Adderall stuff has got to be stopped. Seven out of ten kids in college are on this stuff and it's no more than methamphetamine! It's speed.”

i'm sorry but can someone tell me why she is to be forgiven for something that anyone else would be looked down upon?? She clearly thinks that she is above and beyond any sort of law and that is fair how?? She is a person just like you, me and the next person. Other than money and fame nothing seperates her from my next door neighbor. I see them both infrequently and no words are shared when I do see them. Lindsey needs to pay the same time as anyone else. Besides... "freaky friday" and "georgia rule" arent even good movies. She might even learn how to act while shes in prison... Dont they have books on that in there. Good luck Lindsey!! this is such b.s. why do these people think they are so more important than anyone else. two weeks what the hell has she learned in that kind of time. i'll tell you what she's learn, nothing except that she can do it again and again.

If you can't do the time don't do the crime. No excuses just do your jail time Lohan and quite being a crybaby. You knew what was required of you . Just because you a "star" why should you not have to do the same as any ordinary person would have no choice but to do. Suck it up be an adult and change the way you're doing things!

Instead of worrying about whether Lindsay Lohan gets out of jail soon, we SHOULD be worrying about the men and women fighting for our freedom that is sacrificing their lives for us. THAT is what is important! Lindsay is a sick girl who needs alot of help. Jail will not cure her either. It will take therapy and lots of it. We need to get our heads out of the sand and worry about more important things other than some rich spoiled punk kid in Hollywood.

Lindsay Lohan needs to be in jail for her own good.
She has no respect for the law or herself.
If Lindsay continues on her path of drugs and alcohol, she will die.
The time in jail will hopefully open her bloodshot eyes.
If not, then Lindsay is in trouble.

I am sick to death of all these pampered 'celebrities' who are making big bucks and getting special treatment. This girl has had her 2 chances so I say that she should be kicked out of hollywood and be forced to live in the real world where she will have to 'pay' for her crimes. These people are being looked up to by our young people and these young people think they will be able to 'just go to rehab' and 'no problem' if we do it again and again. How are parents supposed to tell their children to be good, responsible citizens when they ca see what these hollywood brats are getting away with. I am at a loss to understand why the hollywood mgmt puts up with these irresponsible people.

Give me a break. She did the crime, she needs to do the time. We are talking about 23-24 days. She is not above the law. It is not life in prison. She should be grateful she did not kill an innocent person or family in her drunken stumper. Now is a good time for her to practice patience. Should we be sorry she did not see her family over the weekend? I think not. She saw them all week,while the rest of the inmates had to wait to see their family on weekends. Turn around is fair. Lindsay needs to get with it. The world does not revolve around her and she is not that good of an actress. The quicker she learns that, the sooner she can start to get better. Ego is a dangerous thing. If Lindsay chooses to keep on doing what she is doing it will come down to the choices of jail or death.

it is puzzling why everybody is rallying to "free lindsay".she blatantly ignored the judge on more than one occasion.she had a vulgarity on her fingernail in court.she deserves to be in jail.im tired of pampered celebrities getting a slap on the wrist for thier crimes.if i did what she did,id still be locked up,in general population.she is basically useless to society anyway.its not like shes a good actress or singer.make her serve her sentence,when she gets out,she will screw up again and end up right back to this point.i would compare this to dana plato,but at least dana plato could act a little bit.
